1. Premise

This notice is provided pursuant to Art. 13 of EU Regulation 2016/679 (hereinafter "GDPR") and Legislative Decree 196/2003 (Privacy Code), as amended by Legislative Decree 101/2018, and describes the methods of processing personal data of users who visit the site https://guida-tv.com (hereinafter "Guida-TV").

This notice is provided exclusively for this site and not for other websites that the user may visit through external links.

This data, necessary for the use of web services, is processed in order to obtain anonymous statistical information on the use of the site and to check its correct functioning. Navigation data does not persist beyond the time necessary for the session, except for possible use in determining responsibility in the event of hypothetical computer crimes against the site.

3.2 Data voluntarily provided by the user

The site does not provide registration forms, newsletter subscriptions, or other methods of direct collection of personal data. The user is not asked to provide name, surname, email address, or any other identifying personal data.

5. Processing Methods

Personal data is processed using automated tools for the time strictly necessary to achieve the purposes for which it was collected. Specific security measures are adopted to prevent data loss, unlawful or incorrect use and unauthorized access.

The site is hosted on Cloudflare infrastructure (Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA). Cloudflare operates as data processor pursuant to Art. 28 of the GDPR and adheres to the EU-US Data Privacy Framework for the transfer of personal data outside the European Economic Area.

6. Communication and Disclosure of Data

Users' personal data is not transferred to third parties nor disclosed. Navigation data may be communicated to competent authorities exclusively in the event of a legitimate request and within the limits provided by law.

The parties that may become aware of the data as processors or persons in charge of processing are:

  • The hosting service provider (Cloudflare, Inc.)
  • Any statistical analysis service providers (only with user consent)

7. Extra-EU Data Transfer

The site uses services from Cloudflare, Inc. based in the United States. The transfer of data to the USA is based on the following guarantees:

  • Cloudflare's adherence to the EU-US Data Privacy Framework (European Commission adequacy decision of July 10, 2023)
  • Standard contractual clauses approved by the European Commission (Art. 46, par. 2, lett. c, GDPR)

8. Retention Period

  • Navigation data: processed for the duration of the session and not retained beyond, except as required by law.
  • Cookie preferences (localStorage): stored in the user's browser until explicit revocation. Not transmitted to external servers.
  • Analytics data: retained in aggregate and anonymous form for a maximum of 26 months from collection.

9. Data Subject Rights

Under Articles 15-22 of the GDPR, the user has the right to:

  • Access (Art. 15): obtain confirmation of whether personal data is being processed and, if so, obtain access to the data and information about the processing.
  • Rectification (Art. 16): obtain the rectification of inaccurate personal data or the completion of incomplete data.
  • Erasure (Art. 17): obtain the erasure of personal data, in the cases provided by the GDPR.
  • Restriction (Art. 18): obtain the restriction of processing in the cases provided by the GDPR.
  • Portability (Art. 20): receive personal data in a structured, commonly used and machine-readable format.
  • Objection (Art. 21): object at any time to the processing of personal data based on legitimate interest.
  • Withdrawal of consent (Art. 7, par. 3): withdraw consent at any time, without affecting the lawfulness of processing based on consent given before the withdrawal.

The controller undertakes to respond within 30 days of receipt of the request, extendable by a further 60 days in case of complexity or high number of requests, with prior notification to the data subject.

10. Complaint to the Supervisory Authority

11. Modifications to this Notice

The controller reserves the right to make changes to this Privacy Policy at any time, giving adequate publicity to users through the site. In case of substantial changes, consent will be requested again where necessary.

The user is invited to periodically consult this page, using the date of the last update indicated above as reference.
